The Bombay High Court on Thursday upheld the constitutional validity of provisions of the Unlawful Activities (Prevention) Act.
The Bench of Justice AS Gadkari and Justice Neela Gokhale observed that UAPA, in its present form, was constitutionally valid.
A detailed copy of the verdict is awaited.
As per a leading English daily, one Anil Babura Baile was issued a notice in 2020 in connection with the Bhima Koregaon violence case of 2018.
He then moved the Apex Court challenging the constitutional validity of UAPA.
In February 2025, the top court of the country had allowed High Courts to proceed with the petitions challenging the amendments to the UAPA on the grounds that the Apex Court should not become the court of first instance, except in rare instances.
A similar petition challenging the provisions of UAPA is pending before the Delhi High Court.
