Former High Court judge K.S. Puttaswamy, who challenged Aadhaar scheme no more

Justice KS Puttaswamy who was Former Karnataka High Court judge has passed away at his residence in Bengaluru on Monday.

Justice KS Puttaswamy who lived for 98 years was enrolled in 1952 as an advocate whereas he was appointed as a judge of the Karnataka High Court in November 1977.

Justice KS Puttaswamy served as a judge in the Karnataka High court till he completed his tenure in 1986.

Justice KS Puttaswamy, served as the vice chairperson of the Central Administrative Tribunal’s Bengaluru Bench after his retirement from the court.

What made Justice Puttaswamy famous was his act of challenging the constitutional validity of the Aadhaar scheme.

Justice Puttaswamy was the first person to challenge the Aadhaar scheme.

Justice Puttaswamy’s challenge on the Constitutional validity of Aadhar led to the Apex Court recognizing the right to privacy under the fundamental right to life under Article 21 of the Constitution.

In the year 2012, Justice Puttaswamy filed a writ petition before the Supreme Court challenging the constitutional validity of the Aadhaar scheme.

The son of Justice Puttaswamy told media that it was after the series of discussions with former governor of Bihar and Jharkhand, along with former Punjab and Haryana High court Chief justice that Justice Puttaswamy decided to contest Aadhaar matter before court.

However, it is pertinent to note that the Apex court held that Right to Privacy is a fundamental right however the court did not deem it fit to strike down the scheme.
