Gujarat High Court directs contractor to pay compensation to victims’ families for boat capsizing

The Gujarat High Court has directed the contractor responsible for a boat capsizing at Harni Lake in Vadodara to provide compensation to the victims.

The incident, which occurred on January 18, 2024, resulted in the loss of lives and injuries to several people. The court’s order came in response to a public interest litigation (PIL) filed by the victims’ families, seeking compensation for the damages caused by the incident.

The Division Bench of Chief Justice Sunita Agarwal and Justice Pranav Trivedi noted that the contractor was responsible for the incident and directed them to provide compensation to the victims.

To facilitate the process of providing compensation, the court directed the Collector of Vadodara to nominate an officer to compute the compensation.

The court also directed the District Legal Services Authority (DLSA) to provide legal aid to the victims in the computation process.

The court clarified that the computation of compensation would be made by applying the principles of computation of compensation in cases of death and injury under the Motor Vehicles Act, 1988.

The court also directed the officer concerned to pass the order of computation within a period of eight weeks. The Court posted the matter on January 1, 2025.
