Supreme Court refuses to entertain plea on IndiGo crisis

The Supreme Court on Tuesday declined to entertain a petition concerning the ongoing operational crisis faced by IndiGo Airlines, directing the petitioner to approach the Delhi High Court instead. The Apex court made it clear that it was not inclined to exercise its jurisdiction in the matter at this stage.

The plea raised concerns relating to disruptions in flight operations and the alleged impact on passengers, seeking judicial intervention to address the issues reportedly affecting the airline. However, the Supreme Court observed that the issues flagged in the petition could be more appropriately examined by the Delhi High Court.

During the hearing, the Bench noted that the High Court is better placed to consider the factual aspects and grant relief, if warranted. It accordingly refused to entertain the plea while leaving all issues open for consideration before the appropriate forum.

By directing the petitioner to move the Delhi High Court, the Supreme Court reiterated its consistent approach of discouraging litigants from bypassing the hierarchy of courts, particularly when an effective alternative remedy is available.

The order brings an end to the proceedings before the apex court, though it does not preclude the petitioner from pursuing the matter before the High Court in accordance with law.
