Delhi High Court declines to hear fresh PIL over IndiGo controversy

The Delhi High Court has declined to consider a new public interest litigation seeking judicial intervention in connection with the recent controversy involving IndiGo airlines. The Court observed that it was not inclined to entertain a fresh PIL on the issue, particularly when similar concerns had already been examined or were capable of being addressed through appropriate statutory mechanisms.

The bench emphasised that public interest litigation cannot be used as a tool to repeatedly raise the same grievance under the guise of public concern. It noted that courts must exercise caution to prevent the misuse of PIL jurisdiction, especially in matters where regulatory authorities are already seized of the issue.

The High Court further remarked that individuals affected by the incident have adequate legal remedies available under existing laws and may pursue their claims before the appropriate forums. Entertaining multiple PILs on the same subject, the Court said, risks judicial overreach and unnecessary duplication of proceedings.

By refusing to admit the fresh petition, the Delhi High Court reinforced the principle that PILs are meant to address genuine issues affecting the public at large and not to reopen matters already under scrutiny or capable of resolution through established legal channels.
