The Supreme Court has set aside a decision of the Punjab and Haryana High Court that had ordered a CBI investigation into the Ambience Island real estate project in Gurugram. The apex court held that the direction for a criminal probe was not legally justified and therefore could not be sustained.
The dispute relates to the development of residential and commercial structures on land located in Nathupur village, along the Delhi–Jaipur highway. Homebuyers had alleged that the land use norms were violated, claiming that areas meant for residential purposes were later utilised for commercial development, including a shopping mall and other constructions.
In an earlier ruling, the High Court had cancelled certain delicensing and relicensing approvals granted by the Haryana Department of Town and Country Planning and had instructed the state authorities to take corrective steps. Along with this, it had also ordered a CBI inquiry into the matter, citing alleged irregularities.
However, the Supreme Court disagreed with the direction for a CBI probe, observing that such an order was not warranted in the facts of the case. While setting aside that portion of the judgment, the Court clarified that other legal proceedings connected to the project would continue independently.
The Court further noted that issues pending before the National Green Tribunal would remain on hold until the High Court decides a separate writ petition filed by homebuyers, and that such proceedings should not be influenced by the Supreme Court’s observations.
The ruling brings temporary relief to stakeholders of the Ambience Island project, while keeping the broader legal challenges surrounding land use and regulatory approvals open for adjudication.
