Delhi High Court disposes of plea after DU agrees to reschedule law exam for students celebrating Bakrid

The Delhi High Court on Tuesday disposed of a petition challenging the decision of the University of Delhi (DU) to conduct law examination on May 28 after DU informed the Court that students observing Eid al-Adha (Bakrid) would be permitted to take the examination on a later date after July 4.

The submission was made before the single-judge Bench of Justice Jasmeet Singh during the hearing of a writ petition filed by a law student challenging the varsity’s decision to hold the examination on the date declared as a public holiday by the Central government for Bakrid.

The Counsel appearing for DU submitted that students belonging to the minority community and other students intending to participate in Bakrid festivities could inform the Dean of the Faculty of Law through email by Wednesday, following which the examination scheduled for May 28 would be rescheduled after July 4.

Recording the submission, the Court directed that affected students communicate their request to the Dean, Faculty of Law, through email. The Court further directed that the revised examination date be intimated to the concerned students at least one week in advance through electronic communication. In view of the statement made on behalf of the University, the writ petition was disposed of.

The petition had challenged an office memorandum dated May 25, 2026 issued by the University continuing with the scheduled examination for the subject “Public Policy and Administration” for students of the Integrated Law Course despite the Union government shifting the Bakrid holiday from May 27 to May 28.

The petitioner contended that the decision was arbitrary, unreasonable and violative of Articles 14, 21, 25 and 29 of the Constitution. It was argued that Muslim students and similarly placed candidates were being compelled to choose between appearing for the examination and participating in religious observances connected with Eid-ul-Zuha.

The plea further stated that several constitutional institutions and public authorities, including the Supreme Court of India, had already rescheduled the Bakrid holiday in conformity with the notification issued by the Central government, whereas the University had continued with the examination schedule without providing accommodation to affected students.

According to the petition, the impugned office memorandum lacked any rational basis and was contrary to constitutional principles of secularism, equality, fairness and protection of religious freedoms guaranteed under the Constitution. The petitioner also sought quashing of the office memorandum and interim stay on the conduct of the examination scheduled for May 28.
