Bollywood actor Tabu (Tabassum Jamal Hashmi) approached the Delhi High Court on Tuesday seeking protection of her personality rights against the unauthorised use of her identity, name and likeness.
The matter came up before Justice Jyoti Singh, who asked Senior Advocate Swathi Sukumar, appearing for the actor, to file a fresh memo of parties after noting that the existing filing did not correctly mention the particulars of some of the defendants. The Court has listed the matter for further hearing on August 6.
Tabu’s plea adds to a growing number of personality rights cases being entertained by the Delhi High Court, which has consistently granted protection to celebrities, public figures and content creators against the unauthorised commercial exploitation of their names, images, voices and other identifying attributes, particularly in the digital space.
In recent months, the High Court has passed orders safeguarding the personality rights of cricketers Abhishek Sharma and Yuvraj Singh, Congress leader Shashi Tharoor, and Andhra Pradesh Deputy Chief Minister Pawan Kalyan.
The Court has also extended similar protection to entrepreneur Aman Gupta, actors Allu Arjun, Mohanlal, Kajol, R. Madhavan, and N. T. Rama Rao Jr., spiritual preacher Aniruddhacharya, singer Jubin Nautiyal, and former cricketer Sunil Gavaskar. A similar suit seeking protection of personality rights has also been filed by Salman Khan.
Coordinate Benches of the High Court have likewise issued protective orders in favour of Sri Sri Ravi Shankar, Nagarjuna, Aishwarya Rai Bachchan, Abhishek Bachchan, and filmmaker Karan Johar.
The Delhi High Court has also recognised personality rights in favour of journalist Sudhir Chaudhary, who sought relief against allegedly misleading AI-generated videos circulating on social media, and podcaster Raj Shamani, in whose case the Court passed a John Doe order after observing that he is a widely recognised public figure, particularly in the field of digital content creation.
