The Delhi High Court has directed the Delhi Development Authority (DDA) to ascertain whether flats constructed for residents of Kaathputhli Colony have been completed and, if so, initiate the process of relocating eligible allottees from the transit camp at Anand Parbat.
A Bench of the High Court passed the directions while hearing a petition instituted by the Kaathputhli Residents Welfare Association, which sought the rehabilitation of around 2,800 families who have been residing in transit accommodation since 2014.
The petitioners told the Court that the affected families have remained in the transit camp for nearly 12 years despite the flats earmarked for their rehabilitation at Kaathputhli Colony having allegedly been completed. They sought directions for the authorities to facilitate their relocation to the permanent housing without further delay.
The DDA disputed the petitioners’ assertion regarding completion of the flats. Its counsel informed the Court that instructions on the status of the construction were not available at the time of hearing.
In view of the conflicting positions, the Court directed the DDA to verify the status of the flats. It further ordered that if the units have indeed been completed, the authority should commence the process of shifting those beneficiaries who are eligible for allotment.
The Court also addressed the living conditions at the transit camp, particularly concerns relating to essential civic services. It directed the authorities to ensure uninterrupted access to electricity, water and sanitation facilities for the residents.
The direction assumes significance in view of the petitioners’ apprehension that disputes between the DDA and the private developer could adversely affect the provision of basic amenities to families who have already spent several years in temporary accommodation.
The petition has arrayed the DDA, the Ministry of Housing and Urban Affairs, the Government of the National Capital Territory of Delhi and Raheja Developers Ltd. as respondents. The proceedings arise from the prolonged rehabilitation process concerning residents of Kaathputhli Colony.
The petitioners were represented by senior advocate Dr Amit George, assisted by advocates Zafar Khurshid and Udit Chauhan.
The Court’s order does not finally adjudicate the claims raised in the petition. Instead, it requires the DDA to establish the present status of the rehabilitation flats and, subject to their completion and the eligibility of the concerned residents, take steps towards their relocation.
The matter highlights the prolonged difficulties faced by residents awaiting rehabilitation following their displacement from Kaathputhli Colony. With the Court directing the DDA to verify the construction status and proceed with shifting if the flats are ready, the next stage of the rehabilitation process will depend on the authority’s compliance with the directions.
