A Gurugram court on Wednesday remanded Kalyan Bainsla, the man accused of allegedly ramming his vehicle into a woman biker on Golf Course Road, to police custody for two days.
Judicial Magistrate First Class Nidhi Beniwal also ordered the police custody of Bainsla’s cousin, Lavneesh, who has been arrested in connection with the case. Both accused were produced before the court after being apprehended in Rajasthan and brought to Gurugram on Tuesday.
The accused are scheduled to be produced before the court again on September 18.
Advocate Lalit Bindal appeared for the accused during the proceedings.
The case was registered at the Sector 55/56 Police Station under Section 109 of the Bharatiya Nyaya Sanhita (BNS), relating to attempt to murder, along with Section 281 concerning rash driving and Section 125 pertaining to acts endangering the life or personal safety of others.
During the remand proceedings, the police also invoked Sections 78 and 79 of the BNS, concerning stalking and words, gestures or acts intended to insult the modesty of a woman, respectively.
The criminal case originated from a video uploaded on social media by the alleged victim, Shivani Chauhan, who uses the name ‘Sia’ online. The footage, recorded through a camera installed on her motorcycle, purportedly shows a vehicle allegedly driven by Bainsla approaching her at speed and colliding with her bike.
Chauhan is seen being thrown from the motorcycle following the impact. She subsequently alleged that Bainsla had allegedly harassed her prior to the incident and thereafter left the scene.
The video subsequently gained widespread traction on social media, following which Gurugram Police registered a suo motu case.
The police did not initially incorporate the offence of attempt to murder in the FIR. Section 109 of the BNS was subsequently added to the case as the investigation progressed.
According to the prosecution case, Bainsla, who is described as a gym owner, has been identified in the court record as Kalyan Singh.
The allegations have triggered considerable public attention, with the incident generating widespread discussion on social media and calls for stringent action against the accused.
The two-day custodial remand will enable the investigating agency to question the accused and pursue the investigation into the circumstances surrounding the alleged collision, the events preceding it and the subsequent conduct attributed to them.
