A Delhi court on Wednesday sought a response from the Delhi Police on a complaint seeking registration of an FIR against student-activist Nishu Azad and her father, Sanjay Azad, over alleged social media posts containing objectionable references to Hindu deities.
Chief Judicial Magistrate Mridul Gupta of the Patiala House Court, directed the Delhi Police to file an action taken report on the complaint. The matter will next be heard in January 2027.
The court was hearing a plea filed by advocate Amita Sachdeva, who had earlier approached the Delhi Police with a complaint seeking registration of an FIR.
Sachdeva’s complaint refers to four social media posts allegedly uploaded between September 2023 and August 2026, concerning Hindu deities including Shiva, Krishna, Saraswati and Durga.
She alleged that the posts were deliberately published and continued to remain accessible despite her request seeking their removal.
The petitioner has sought registration of an FIR under Sections 299 and 196 of the Bharatiya Nyaya Sanhita (BNS), concerning deliberate and malicious acts intended to outrage religious feelings and promoting enmity between groups, respectively. She has also invoked relevant provisions of the Information Technology Act.
The complaint comes amid a recent controversy involving Nishu Azad and her father in connection with protests at Delhi’s Jantar Mantar. Right-wing influencer Swatantra Bhardwaj had alleged in a video that he assaulted Sanjay Azad during the protests.
Bhardwaj was subsequently arrested in connection with the incident and later released on interim bail.
The present proceedings before the Delhi court are, however, based on separate allegations concerning social media content. The court has so far only sought an action taken report from the Delhi Police and has not passed any order directing registration of an FIR.
