The Supreme Court on Wednesday remarked that the Krishna Janmabhoomi-Shahi Idgah dispute was “jinxed”, while expressing concern over repeated adjournments in the matter.
A Bench of Justices Sanjay Kumar and Sanjeev Sachdeva were hearing a plea challenging an Allahabad High Court order that had designated one Hindu party as the representative of all devotees of Lord Krishna.
The Bench expressed frustration over constant delays, calling the case “jinxed” because it keeps getting postponed instead of being heard.
The remark came after the Court was informed that the plaintiffs before the High Court had been unable to reach an understanding. The parties had earlier indicated the possibility of a settlement concerning differences within the Hindu side.
The Supreme Court said it would hear the parties on the merits. However, owing to paucity of time, the matter was adjourned to November 6.
The dispute concerns the Shahi Idgah Masjid at Mathura, with Hindu plaintiffs claiming that the mosque was constructed on land associated with the Krishna Janmabhoomi.
The civil suit was instituted on behalf of Hindu deity Bhagwan Shri Krishna Virajman and certain devotees, seeking removal of the mosque from the disputed site.
The plaintiffs have also claimed that various features and circumstances indicate that the Shahi Idgah Mosque was built over a Hindu temple. They consequently sought the appointment of a commission to inspect the site.
A civil court had initially dismissed the suit in September 2020, holding that it was barred by the Places of Worship (Special Provisions) Act, 1991.
The decision was subsequently overturned by the Mathura District Court, which held in May 2022 that the suit was maintainable.
The proceedings were later transferred to the Allahabad High Court in 2023.
