Delhi Court Denies Lalu Prasad Yadav’s request for unrelied documents in Land-for-Jobs Case

A Delhi court has turned down an application filed by Lalu Prasad Yadav seeking access to documents that the prosecution has not relied upon in the land-for-jobs case. The ruling reinforces the limited scope of document disclosure available to the accused during trial.

The plea was submitted on the ground that all materials collected during the investigation, including those not cited in the chargesheet, should be shared with the defence to ensure a fair opportunity to contest the allegations. Yadav’s counsel argued that such access was essential for preparing an effective defence.

The court, however, did not accept this contention. It clarified that the prosecution is only obligated to provide documents it intends to use in support of its case. Materials that are not relied upon do not fall within the mandatory disclosure requirement, and the accused cannot claim them as a matter of right.

The case itself revolves around allegations that appointments in the railways were made in exchange for land parcels transferred to individuals connected with Yadav. The investigation, led by the Central Bureau of Investigation, has alleged a conspiracy involving misuse of official position for personal gain.

By rejecting the application, the court reiterated established legal principles governing criminal trials, emphasising that disclosure rules are meant to ensure fairness without unnecessarily expanding the scope of proceedings. The decision allows the trial to move forward based on the evidence formally relied upon by the prosecution.
