A Delhi court on Tuesday ordered the Delhi Police to register a First Information Report (FIR) against former Delhi Chief Minister Arvind Kejriwal and two other politicians on a complaint alleging misuse of public funds and defacement of public property.
Additional Chief Judicial Magistrate (ACJM) Nishant Garg of the Rouse Avenue Courts directed the Delhi Police to register an FIR against Kejriwal, former BJP MLA Gulab Singh and Dwarka Councillor Nitika Sharma, and listed the matter for further hearing on March 18.
The ACJM further directed the Delhi Police to file a compliance report on the next date of hearing.
The order was passed on a complaint filed by one Shiv Kumar Saxena alleging violations of provisions of the Delhi Prevention of Defacement of Property Act, 2007.
The complainant accused Kejriwal, Singh, and Sharma of allegedly putting up large illegal hoardings in Dwarka using public money.
The matter dated back to 2019, when a complaint was filed against the accused in a lower court. The metropolitan magistrate dismissed the complaint in 2022. The petitioner then moved the sessions court, which set aside the order in January 2025. Special Judge Vishal Gogne held that the Magistrate failed to determine whether the alleged offence was cognisable. The Special Judge directed the Magistrate to hear the matter afresh.
A new petition has now been filed under Section 156(3) of the Code of Criminal Procedure (CrPC) seeking registration of FIR against Kejriwal, Singh and Sharma.
The plea allows the Magistrate to direct the police to register an FIR and investigate the cognisable offence.
