Delhi High Court to hear tomorrow Engineer Rashid plea seeking deletion of bail condition

The Delhi High Court will hear on Friday, a petition filed by Baramulla Member of Parliament (MP) Abdul Rashid Sheikh alias Engineer Rashid, seeking deletion of the bail condition that he would have to pay expense for his commute from Tihar jail to Parliament.

On March 26, the High Court had granted bail to Engineer Rashid on a set of conditions, including the payment of travel expense. The Bench, however, did not specify any specific amount to be paid by Rashid.

The fresh petition sought deletion of the said condition on the grounds that the authorities were demanding Rs 1.45 lakh per day for such travel.

The matter was on Thursday mentioned by Advocate Vikhyat Oberoi before the Bench of Chief Justice Devendra Upadhyaya and Justice Tushar Rao Gedela.

The Bench asked whether the Court would determine the amount borne by the government. It further asked if the issue could be dealt with the appeal.

Rashid contended in his plea that he was not seeking reduction of the expense but deletion of the condition on the grounds he was allowed to attend the session twice without any such condition.

Appearing for Rashid, Advocate Oberoi said said people of the constituency last time did crowd funding. He could attend the session today, but may not money tomorrow for the same. Baramulla would go unrepresented in the Parliament.

He sought permission to attend the Session without paying for the commuting expense.

The Bench said the plea would be automatically listed for hearing tomorrow.

The Baramulla MP is currently lodged in Tihar Jail. He was arrested in a terror funding case under the Unlawful Activities (Prevention) Act in 2019.

Rashid won the Baramulla Lok Sabha seat in the 2024 elections by defeating current Jammu and Kashmir Chief Minister Omar Abdullah by over two lakh votes.

He had approached the High Court seeking permission to attend the Parliament session.

The High Court allowed his plea on March 26 subject to certain conditions.

He was directed to bear the expense for the travel from Tihar jail to Parliament and back.
