Gauhati High Court dismisses PIL over construction irregularities in Arunachal Pradesh

The Gauhati High Court recently heard a Public Interest Litigation (PIL) by Sangha Tanang, a resident of Mangio village in Kurung Kumey District, Arunachal Pradesh, alleging that a fund of Rs 11.82 crores was sanctioned for the construction of 12 community halls under the CD Block, Parsi Parlo, but the construction was carried out without proper documentation and at locations far away from the original sites.

The petitioner claimed that the construction was not geotagged and was done without obtaining necessary certificates, such as land availability, non-duplicity, and non-incumbrance certificates. 

The petitioner also alleged that despite submitting a representation to the authorities on January 14, 2025, no action was taken, and the Deputy Commissioner, Koloriang, Kurung Kumey District, failed to provide a report sought by the authorities.

The Itanagar Division Bench of Justice Kalyan Rai Surana and Justice Mridul Kumar Kalita, however, observed that the PIL was premature, as the petitioner had submitted the representation to the authorities only on January 14, 2025, and the PIL was filed on January 28, 2025. 

The court held that the authorities should be given an opportunity to examine the matter and take necessary action.

In view of this, the court closed the PIL, granting the petitioner liberty to approach the court again if they were aggrieved even after a month.
