The Gauhati High Court recently disposed of a public interest litigation (PIL) petition filed by Mindar Kiri Taron, alleging that the Public Works Department (PWD) had failed to complete a 15.550-km road connecting Borlangpher to Lumding via Chotalangpher under the Pradhan Mantri Gram Sadak Yojana (PMGSY).
The petitioner contended the authorities had not considered the presence of a railway track near Borlangpher, which made the road unusable without a thoroughfare.
The petitioner prayed for the respondents to provide vehicular connectivity across the barricaded railway track by setting up a manned railway crossing.
However, it was clarified by the state that the 15.550 km road had already been constructed, and an additional affidavit was filed to support this claim.
The Division Bench of Chief Justice Vijay Bishnoi and Justice N. Unni Krishnan Nair noted that the Executive Engineer, PWD, Diphu Road Division, had written to the concerned Railway Authority requesting the construction of a Road Over Bridge (ROB) at Borlangpher, but had received no response.
Considering that the PMGSY road had been constructed and the PWD authorities had taken up the matter with the Railway Authorities, the court found that no further order was required in the PIL petition.
The court expected the PWD authorities to pursue the Railway Authorities to construct the ROB at Borlangpher.
