The Gujarat High Court has dismissed a Public Interest Litigation (PIL) by one Musabhai Baplabhai Maru against unattended cattle in the town of Dhandhuka.
The petitioner claimed to be a permanent resident of Dhandhuka and an agricultural operator, and alleged that the problem of uncontrolled cattle was common in the town, causing inconvenience to the people.
The petitioner further stated that the concept of ‘Dhol Dabba’, where uncontrolled cattle were caught and kept on land allotted by the Nagarpalika, had been stopped, resulting in an increase in the population of uncontrolled cattle.
However, the Division Bench comprising Chief Justice Sunita Agarwal and Justice Pranav Trivedi observed that the submissions made by the petitioner were vague and that a factual inquiry was required to be made.
The court also noted that the public interest sought to be agitated in the writ petition was not reflected from the record.
Furthermore, the court held that if the petitioner had any grievance with regard to any policy of the Nagarpalika, the remedy was to approach the competent authority of the Nagarpalika.
In view of the above, the court dismissed the PIL, holding that it did not find any good ground to entertain the writ petition.
The court also observed that it was open for the petitioner to approach the competent authority of Dhandhuka Nagarpalika for redressal of his grievance.
