National Green Tribunal dismisses plea citing violation of animal rights, environmental norms

The National Green Tribunal’s (NGT) Principal Bench has dismissed an application filed by Naresh Kadyan and another applicant citing various environmental and animal welfare laws and sought action against the Department of Animal Husbandry, Dairying, and Fisheries, among others.

However, the NGT found the application, listing the Food Safety and Standards Act, 2006, the Prevention of Cruelty to Animals (Slaughter House) Rules, 2001, the Prevention of Cruelty to Animals Act, 1960, the Air (Prevention & Control of Pollution) Act,1981, the Veterinary Council of India Standard of Professional Conduct, Etiquette and Code of Ethics, for Veterinary Practitioners Regulations, 1992, etc., lacking in factual background and specific details on violation of environmental norms. 

The tribunal noted that the application quoted numerous legal provisions but failed to provide material particulars on the loss of grazing lands or specific geographical areas affected.

The NGT deemed the prayers made in the application vague and unconnected, violating the National Green Tribunal (Practices and Procedure) Rules, 2011. 

The Bench of Justice Prakash Shrivastava, Justice  Arun Kumar Tyagi , Expert members Dr A. Senthil Vel and Dr Afroz Ahmad dismissed the application but granted liberty to the applicants to file a fresh application with proper factual background and particulars if they find environmental norm violations.
