The Punjab and Haryana High Court has disposed of a Public Interest Litigation (PIL) filed for no follow up of due process of law while allotting a medical shop within the premises of Guru Nanak Dev Hospital, Amritsar.
The petitioner claimed that the guidelines for opening new Pradhan Mantri Bhartiya Jan Aushadhi Kendras (PMBJKs) were not adhered to in the allotment process.
During the hearing, the State counsel referred to a reply dated December 19, 2024, sent by the Medical Superintendent of Guru Nanak Dev Hospital Complex, Amritsar.
The reply stated that the medical shop was currently being run by the hospital’s employees, and therefore, there was no need to float any tender or advertisement.
Considering the State’s stance, the High Court deemed it unnecessary to keep the petition pending.
The Division Bench comprising Chief Justice Sheel Nagu and Justice Sudhir Singh disposed of the PIL with a direction to the respondent authorities, stating that when a private individual or agency is allotted the medical shop, the procedure laid down in the guidelines must be followed.
