Supreme Court plans special sitting during Winter Break to hear urgent cases

The Supreme Court of India has decided to convene a special sitting during the winter vacation to hear matters requiring immediate judicial intervention. The sitting is likely to be held on December 26 or December 29, depending on administrative feasibility.

The decision was communicated in open court, where it was clarified that only genuinely urgent cases will be taken up during the special session. To ensure this, the Supreme Court Registry has been directed to carefully scrutinise all pleas seeking urgent listing and place only those that meet the required threshold before the Bench.

The Court emphasised that routine or non-urgent matters will not be entertained during the vacation sitting. Lawyers seeking urgent hearings must demonstrate compelling reasons, supported by complete pleadings and readiness to argue the matter.

This move follows the Court’s recent practice of remaining accessible during vacation periods for pressing cases involving issues such as liberty, protection from coercive action, or other time-sensitive concerns. The judges also indicated that the workload during the vacation sittings would be limited to prevent misuse of the urgent listing mechanism.

Regular hearings in the Supreme Court are scheduled to resume after the winter recess in early January. Until then, the special sitting is intended to strike a balance between judicial availability and procedural discipline.
