The Supreme Court has expressed serious concern over an administrative lapse by its Registry after petitions challenging the same impugned order were listed before different benches of the Court.
The issue arose during the hearing of a petition stemming from an Allahabad High Court order. A Bench comprising Justices Rajesh Bindal and Atul S. Chandurkar noted that another petition arising out of the very same FIR and High Court order had already been taken up by a different Bench, which had issued notice and granted interim relief.
The judges observed that listing connected matters before separate benches could lead to conflicting orders and unnecessary duplication of judicial effort. Calling the practice unacceptable, the Bench directed that the later-listed petition be placed before the Bench that had already heard the matter, subject to appropriate orders from the Chief Justice of India.
The Court also asked the Registry to submit a factual report to the Chief Justice explaining how petitions from the same impugned order came to be assigned to different benches. It stressed that accountability must be fixed for such lapses to ensure better case management and consistency in judicial proceedings.
The Supreme Court reiterated that matters involving identical facts or legal issues must be placed before the same bench to preserve institutional discipline and avoid confusion in the administration of justice.
