The Supreme Court will hear on Friday, a petition filed by HDFC Bank CEO Sashidhar Jagdishan, seeking to quash the FIR registered against him at the behest of Lilavati Kirtilal Mehta Medical Trust.
The Bench of Justice MM Sundresh and Justice K Vinod Chandran agreed to list the matter tomorrow.
Appearing for Jagdishan, Senior Advocate Mukul Rohatgi sought urgent listing of the plea on the grounds that three Bombay High Court judges had recused from hearing the matter, causing a delay in listing.
Rohatgi contended that a frivolous FIR had been lodged against the HDFC Bank and it’s MD by trustees of the Lilavati hospital, who were litigating against the other group of trustees. The bank had to recover money from them. In order to twist the arm, they lodged an FIR through the Magistrate against the MD.
The Senior Counsel apprised the Apex Court that Jagdishan had earlier approached the High Court. After three Benches of the High Court recused from hearing, the matter was tentatively listed for hearing on July 14. The bank was suffering daily due to the case, he added.
As per the FIR, Jagdishan had accepted a bribe of Rs 2.05 crore from erstwhile Trustee Chetan Mehta, for giving him financial advice and helping him to retain control over the Trust’s governance. Jagdishan also interfered with the internal matters by misusing his position as the head of the HDFC Bank.
The petition filed by Jagdishan was initially listed for hearing before the Division Bench of Justice Ajay Gadkari and Justice Rajesh Patil of the High Court on June 18. However, Justice Patil cited some personal difficulty and recused from hearing the matter.
Jagdishan’s legal team, led by Senior Counsel Amit Desai, subsequently mentioned his petition before the Bench of Justice Sarang Kotwal and Justice Shyam Chandak. However, Justice Kotwal recused.
The matter was later listed before a Division Bench of Justice Mahesh Sonak and Justice Jitendra Jain. Justice Jain, who disclosed that he had shares in the HDFC bank, recused after an objection was raised against him hearing the case.
As per an earlier administrative order of the High Court, cases related to the Lilavati Trust were not to be listed before six other judges of the High Court.
