The Chief Justice of India Surya Kant has remarked that the trade unions have been a major factor in slowing the country’s industrial progress, stating that their actions have contributed to the shutdown of numerous industrial units. The observation was made during proceedings before the Supreme Court while hearing a petition related to labour welfare issues.
The Chief Justice noted that while worker rights and protections are important, excessive or aggressive trade union activities have, in many cases, discouraged industrial development. He pointed out that several traditional industries have failed to survive due to persistent disruptions, ultimately resulting in loss of employment rather than worker welfare.
The Chief Justice of India Surya Kant also highlighted the changing nature of employment and cautioned against rigid labour frameworks that may not align with modern economic realities. He observed that industrial growth is essential for job creation and economic stability, and policies must strike a balance between safeguarding workers and ensuring a conducive environment for industries to function.
The court reiterated that matters relating to labour policy and economic reform fall within the domain of the legislature and executive, and judicial intervention has its limits. The bench emphasized that long-term solutions require comprehensive policy decisions rather than court-mandated directions.
The remarks have sparked renewed debate on the role of trade unions in India’s industrial landscape, particularly in the context of economic growth, employment generation, and labour reforms.
