Allahabad High Court directs payment of gratuity to retired driver within 10 days

The Allahabad High Court has directed the Assistant Labour Commissioner, Kanpur to pay one Ramnath Singh, retired driver, Dr Ram Manohar Lohiya Workshop, the outstanding gratuity of Rs 5,96,929 within 10 days and inform the court.

A Single Bench of Justice Prakash Padia passed this order while hearing a petition filed by Ramnath Singh.

The Court noted that,

Instructions dated 21.11.2024 were placed before the Court by Abhijeet Saxena, counsel, holding brief of AK Saxena, counsel for the respondents no 2 & 3.

It is stated in the aforesaid instructions that a Cheque dated 21.11.2024 for a sum of Rs 5,96,929/- in favour of Ramnath Singh retired driver, Dr Ram Manohar Lohiya Workshop, Kanpur has been issued by the Controlling Authority, Payment of Gratuity Act, 1972, which was forwarded to the concerned department.

After going through the aforesaid instructions, a prayer has been made by counsel for the petitioner to direct the authority concerned to make payment of aforesaid amount to the petitioner without any further delay.

In the facts and circumstances of the case and also in the interest of justice, the Court directed the respondent no 1-Controlling Authority, Payment of Gratuity Act, 1972/Assistant Labour Commissioner, Uttar Pradesh, Kanpur Region, Kanpur to release the aforesaid amount in favour of petitioner within ten days and inform the Court through the Standing Counsel by the next date fixed in the matter.

The Court has fixed the next hearing of the petition on 19.12.2024.
