SCBA, SCAORA condemn calls for CJI Surya Kant’s resignation, caution against undermining Judicial independence

The Supreme Court Bar Association (SCBA) and the Supreme Court Advocates-on-Record Association (SCAORA) have strongly objected to public statements circulating on social media demanding the resignation of Chief Justice of India (CJI) Surya Kant, asserting that such remarks risk eroding public confidence in the judiciary and compromising the dignity of the constitutional institution.

In separate resolutions issued on October 12, both Bar bodies emphasised that the judiciary must be allowed to discharge its constitutional responsibilities independently and without external pressure. They also called upon lawyers and members of the public to uphold the dignity and decorum of the Supreme Court of India.

The SCBA, in its resolution, observed that the judicial system provides every individual with an opportunity to approach the courts and seek appropriate relief in accordance with the law. It expressed concern that statements targeting the head of the judiciary could undermine the institution’s standing.

The Association urged its members and others to exercise restraint in public discourse and maintain respect for the Supreme Court. The resolution was signed by SCBA Honorary Secretary Pragya Baghel.

SCAORA, meanwhile, underscored the judiciary’s pivotal role in safeguarding the rule of law and protecting citizens’ rights. It maintained that concerns relating to judicial functioning must be pursued through established legal and constitutional mechanisms rather than through public campaigns seeking the resignation of the Chief Justice.

The Advocates-on-Record body cautioned that demands for the resignation of the head of the judiciary could adversely affect the dignity attached to the office and weaken public faith in the institution.

It further called upon all concerned to respect judicial independence and ensure that the administration of justice remains free from pressure or interference. The resolution was signed by SCAORA Honorary Secretary Yugandhara Pawar Jha.

The resolutions come amid heightened tensions surrounding protests in the national capital against Chief Election Commissioner Gyanesh Kumar and concerns raised by lawyers over alleged police action and restrictions affecting their movement.

The SCBA and other petitioners have also approached the Supreme Court over the alleged detention of lawyers during the protests. The Court has agreed to hear the related pleas, with CJI Surya Kant emphasising that democratic activities must not obstruct the functioning of the Supreme Court or impede the movement of lawyers, litigants and court staff.

Both Bar associations have stressed that institutional disagreements and grievances must be addressed through appropriate legal channels while preserving the independence, authority and dignity of the judiciary.
