Allahabad High Court dismisses plea to quash FIR in Jaunpur journalist murder case

The Allahabad High Court has dismissed the petition of Arfi alias Kamran, an accused in the daylight murder case of Shahganj, Jaunpur journalist Ashutosh Srivastava.

The Division Bench of Justice Siddhartha Varma and Justice Ram Manohar Narayan Mishra passed this order while hearing a petition filed by Arfi Alias Kamran.

The petition has been filed seeking quashing of the first information report dated 14.05.2024 registered as Case at Police Station Shahganj, District- Jaunpur.

“We have perused the first information report which prima facie discloses cognizable offence and, therefore, the prayer made to quash FIR otherwise cannot be entertained in view of the law laid down by the Supreme Court in the case of M/S Neeharika Infrastructure Pvt Ltd vs State of Maharashtra and Others, (2021) SCC Online SC 315. Under such circumstances, no interference is warranted in the petition,” the Court observed while dismissing the petition.
