The Himachal Pradesh High Court has recently disposed of a suo motu public interest litigation regarding inadequate staff and facilities at Government Degree College, Subathu.
The petition was filed after the court received letters from students highlighting difficulties they faced due to the lack of teachers and infrastructure.
The court noted that the college had been taken over by the government in October 2022, and despite the notification being withdrawn in November 2023, it was later reinstated in March 2024.
The Division Bench of Acting Chief Justice Tarlok Singh Chauhan and Justice Satyen Vaidya observed that the students were facing difficulties in pursuing their studies due to the inadequate staff, particularly in the Commerce stream.
The Secretary (Education) to the Government of Himachal Pradesh filed an affidavit stating that the government was making efforts to optimize the available resources and provide quality education to the students.
The affidavit also mentioned that the institution-wise staffing norms were being worked out, and the rationalization of institutions and staff would be done before the start of the next academic session.
The court took into consideration the fact that the academic session was nearing completion and the state was making efforts to make institution-wise staff norms operative for the next academic session.
Therefore, the court decided not to issue any directions to the state for filling up the posts at that stage. However, the court made it clear that this order would not prevent any student or person from filing a fresh petition on the same or similar grounds.
The court appreciated the valuable assistance rendered by the Legal Aid Counsel and disposed of the petition, along with any pending miscellaneous applications.
