Allahabad High Court rejects plea to install loudspeakers in mosque

The Allahabad High Court has rejected the petition filed by one Mukhtiyar Ahmed of Pilibhit seeking installation of loudspeakers on the mosque.

The Division bench of Justice Ashwani Kumar Mishra and Donadi Ramesh passed this order while hearing a petition filed by Mukhtiyar Ahmad.

 The Court noted that,

The petitioner wants the Court to issue a direction to the State authorities to permit the installation of loudspeakers on a Masjid.

An objection is taken to the maintainability of the writ petition on the ground that the petitioner is neither mutwalli nor the Masjid belongs to him.

The Court found substance in the objection of the State, inasmuch as no locus is shown in the petitioner to file the writ petition. Even otherwise religious places are for offering prayers to the divinity and use of loudspeakers cannot be claimed as a matter of right, particularly when often such use of loudspeakers create nuisance for the residents.

Accordingly, the Court dismissed the petition.
