The Karnataka High Court on Friday dismissed the petitions filed by Nikita Singhania, her mother and her brother, seeking to quash an FIR registered against them for allegedly abetting the suicide of Atul Subhash, a Bangalore-based techie and husband of Nikita.
The order was passed by the single-judge Bench of Justice SR Krishna Kumar after taking on record the memo filed by the Counsel for the petitioner.
The High Court further passed an interim stay order on the petition filed by the uncle of Nikita, Sushil Kumar Singhania.
The single-judge Bench further issued notice to complainant Bikas Kumar and granted time to the Respondent no 2 (brother of deceased) to file a response on the petition.
It ordered that the interim stay as prayed for qua petitioner no 4 would continue till February 26, the next date of hearing.
During the proceedings, the prosecution today apprised the single-judge Bench that a charge sheet would soon be filed in the case.
The Counsel appearing for Sushil Kumar argued that he was a 70-year-old person. The complainant was in furtherance of the death note, wherein Sushil’s name was mentioned, however, the allegations made against him were omnibus. In the entire death note, the deceased had levelled allegations against Nikita and others, he added.
After going through the record, the High Court orally observed that the main allegations were made against Nikita & others and not the petitioner (Uncle).
Kumar, the 34-year-old techie, left behind a ‘justice is due’ placard and a 24-page suicide note. He alleged that the Respondents harassed him, during an ongoing legal battle over divorce, alimony and child custody, which was going on in a family court of Jaunpur district in Uttar Pradesh.
An FIR was lodged against Nikita and her members of her family by Bikas Kumar, the brother of Atul. The accused were earlier granted bail by a court in Bengaluru.
