The Delhi High Court on Thursday stayed the release of film ‘Udaipur Files,’ based on the murder of tailor Kanhaiya Lal Teli, who was allegedly killed by two Islamists in Udaipur in 2022.
After a detailed hearing, the Bench of Chief Justice DK Upadhyaya and Justice Anish Dayal directed the Central government to exercise its revisional powers under Section 6 of the Cinematograph Act and examine the movie, slated to be released on July 11.
The High Court delivered the verdict on a batch of three petitions, including one filed by Jamiat Ulema-e-Hind President Maulana Arshad Madani, seeking a ban on the film for vilifying Muslims.
The Bench observed that although it was not impermissible for the Court to intervene in exercise of its extraordinary jurisdiction under Article 226, the petitioners ought to approach the Central government first.
The Union of India could exercise it’s power suo motu or on an application moved by an aggrieved person against a film certificate. In this case, the petitioners had not taken recourse to the remedy, noted the High Court and ordered them to approach the Central government for interim relief.
It further ordered the Union government to decide on the revision plea within a week, after giving opportunity of hearing to the film’s producer.
Two Islamists allegedly beheaded tailor Kanhaiya Lal Teli in Rajasthan’s Udaipur town on June 28, 2022. They recorded the attack on camera and shared it online.
Lal was killed for allegedly sharing a social media post in support of former Bharatiya Janata Party spokesperson Nupur Sharma, who made certain derogatory remarks against Prophet Muhammad.
