Parole helps prisoners maintain social ties during long incarceration:Delhi High Court

The Delhi High Court has observed that parole plays a crucial role in helping prisoners maintain social and family relationships during prolonged incarceration. The Court made the remarks while hearing a plea filed by a convict who has spent nearly 17 years behind bars and sought temporary release to reconnect with his family and society.

The bench stated that the objective of imprisonment is not confined to punishment alone. Rehabilitation and reformation are equally significant aspects of the criminal justice system. According to the Court, allowing inmates to preserve emotional and social connections can positively influence their mental health and support their eventual reintegration into society.

Emphasising the humanitarian aspect of parole, the Court noted that temporary release enables prisoners to sustain family ties that often weaken after years of incarceration. It further observed that such relief aligns with the constitutional principles of dignity and personal liberty protected under Article 21 of the Constitution.

The High Court also cautioned authorities against rejecting parole applications in a routine or mechanical manner. It said each request must be assessed on its own merits, taking into account factors such as the inmate’s conduct in jail, the possibility of reform, and the need to maintain social relationships. Merely citing the seriousness of the offence, the Court observed, cannot be the sole ground for denial.

Highlighting the reformative purpose behind parole and furlough policies, the bench said that prisoners who have demonstrated satisfactory conduct during incarceration deserve fair consideration of their pleas, especially after spending substantial time in custody. The Court clarified that parole does not reduce the punishment awarded by law but instead serves as a means to encourage rehabilitation and social reintegration.

In recent years, the Delhi High Court has repeatedly stressed the importance of adopting a humane and balanced approach while dealing with parole matters. It has also directed authorities to ensure timely and transparent decisions so that the legal and constitutional rights of prisoners are adequately protected.
