The Supreme Court on Friday recorded the statement made by the Union Government that certain individuals allegedly deported to Bangladesh would be brought back to India for verification of their claims of Indian citizenship.
Recording the submission, the Bench of Chief Justice of India (CJI) Surya Kant, Justice Joymalya Bagchi and Justice Vipul M Pancholi clarified that the decision was being taken in view of the peculiar facts and circumstances of the present case. The Court observed that the respondents’ right to continue in India would ultimately depend on the outcome of the verification proceedings. It further sought a timeline from the Centre regarding the process for bringing the respondents back.
Solicitor General Tushar Mehta, appearing for the Central government, apprised the Court that the individuals were likely to be brought back within approximately eight to ten days.
At the request of the SG, the Bench specifically clarified that the arrangement was being done strictly on an individual basis, and should not be treated as a binding precedent for similar cases in future.
The matter has now been directed to be listed immediately after the reopening of the Court in July for further consideration and possible disposal, depending upon the outcome of the verification exercise.
