Madras High Court seeks response from CM Vijay, minister Aadhav Arjuna in petition challenging their election

The Madras High Court has issued notices to Tamil Nadu Chief Minister C. Joseph Vijay and Cabinet Minister Aadhav Arjuna on a batch of election petitions questioning the validity of their victories in the 2026 Tamil Nadu Assembly elections. The petitions, filed under the provisions of the Representation of the People Act, 1951, have been admitted for consideration, with the Court calling upon the respondents to place their replies on record.

The challenge to Chief Minister Vijay’s election has been mounted by his defeated rival, who alleges that the successful candidate failed to comply with mandatory legal requirements governing electoral disclosures and nomination procedures. Similar allegations have also been raised against Minister Aadhav Arjuna, whose election from the Villivakkam constituency has likewise been brought under judicial scrutiny. While the petitions seek to have their elections declared void, the allegations remain to be tested during the course of the proceedings.

A Single Judge of the High Court, after conducting a preliminary examination of the pleadings, found sufficient grounds to entertain the petitions and directed that notices be served upon the returned candidates. The issuance of notice marks the commencement of the adjudicatory process and should not be construed as an expression on the merits of the claims advanced by the petitioners.

Election petitions are statutory proceedings through which the validity of an electoral mandate may be examined on limited grounds prescribed under the Representation of the People Act, including allegations of corrupt practices, improper acceptance or rejection of nominations, or material non-compliance with electoral law. The burden of establishing such allegations rests squarely upon the petitioners.

The matters are expected to proceed after the respondents file their counter-affidavits, following which the Court will determine whether the petitioners have substantiated the grounds necessary to invalidate the election results. Until such determination, both Chief Minister Vijay and Minister Aadhav Arjuna continue to hold office with the benefit of the electoral mandate conferred upon them.
