Supreme Court Justice BV Nagarathna has stressed the need for Bar Councils to reflect upon their functioning, observing that it is a matter of concern when a regulatory body fails to command the respect and confidence of the very members it is entrusted to represent.
Justice Nagarathna said the Bar Councils, at both the national and State levels, carry a significant institutional responsibility towards maintaining professional standards, ethical conduct and discipline within the legal profession. Their authority, she indicated, should be accompanied by credibility and the trust of the Bar.
The judge emphasised that an independent and professionally robust Bar constitutes an indispensable component of the justice delivery system. Lawyers do not merely discharge obligations towards individual clients; as Officers of the Court, they also bear a larger responsibility towards the administration of justice and the preservation of constitutional values.
Against the backdrop of mounting judicial pendency, procedural delays and the increasing cost of litigation, Justice Nagarathna underscored the need for the legal profession to engage in collective introspection and contribute constructively towards strengthening the justice system.
She also highlighted the importance of preserving the independence of the Bar. Such independence, she noted, is not intended as a professional privilege but serves a larger constitutional purpose by enabling advocates to discharge their duties fearlessly and independently, without being subjected to undue influence.
Justice Nagarathna’s observations also drew attention to the broader responsibilities accompanying the legal profession. Law, she suggested, cannot be viewed merely as a commercial vocation in which legal expertise is exchanged for remuneration. It is a profession founded upon public trust, ethical obligations and a commitment to justice.
Her remarks assume significance amid continuing discussions concerning the functioning and accountability of Bar Councils. The observations underscore that statutory authority alone cannot sustain the legitimacy of a professional regulatory institution. Its credibility must equally flow from transparent functioning, ethical governance, fairness and the confidence it inspires among members of the Bar.
Addressing young law graduates, Justice Nagarathna further emphasised the responsibilities that accompany their entry into the profession. As future members of the Bar, they would have obligations extending beyond individual litigation and would become participants in an institution that plays a central role in the functioning of constitutional democracy.
The underlying message was clear: a Bar Council can effectively discharge its regulatory mandate only when its authority is matched by professional integrity and institutional credibility. Earning the confidence of the Bar, therefore, is not ancillary to its functioning but fundamental to the legitimacy of the institution itself.
