The Delhi High Court permitted the Central Secretariat Club to withdraw its petition challenging an eviction notice issued by the Directorate of Estates, observing that the notice was a direct consequence of the Centre’s decision to withdraw the Club’s recognition and that both issues ought to be considered together by the appropriate roster bench.
The matter was heard by Justice Harish Vaidyanathan Shankar, who noted that the eviction proceedings could not be viewed in isolation as they stemmed from the Union government’s de-recognition order. The Court observed that it was not the designated roster bench to hear challenges relating to the withdrawal of the Club’s recognition.
The petition assailed the July 17 eviction notice issued by the Directorate of Estates under the Union Ministry of Housing and Urban Affairs, which directed the Club to vacate its premises immediately on allegations of misconduct.
Appearing for the Club, Senior Advocate Diya Kapur argued that the Club’s legal existence was independent of government recognition. She submitted that the Club was an association constituted by its members and that the withdrawal of official recognition could not result in the extinguishment of the organisation itself.
The Court, however, observed that both the society and the Club appeared to have been de-recognised and remarked that the very basis of the petition was linked to the recognition granted by the government. Since the eviction notice flowed from the de-recognition order, the Court held that the challenge to both actions should be considered together by the bench assigned to hear the matter.
In view of the Court’s observations, the Central Secretariat Club sought permission to withdraw the petition.
Allowing the request, Justice Harish Vaidyanathan Shankar dismissed the petition as withdrawn, while granting the Club liberty to approach the appropriate roster bench for relief against both the de-recognition order and the consequential eviction notice.
