The Delhi High Court on Thursday indicated that it would pass an interim order directing the removal of obscene, pornographic and derogatory online content targeting actor-politician Ravi Kishan.
The single-judge Bench of Justice Jyoti Singh was hearing a civil suit filed by Kishan seeking protection of his personality rights and the takedown of AI-generated pornographic, defamatory and otherwise objectionable content allegedly circulating on the internet without his consent.
The Court observed that it would direct various defendants, social media intermediaries and digital platforms to remove the impugned content that prima facie violated Kishan’s personality rights. It further indicated that Google would also be required to remove or disable access to web links identified by Kishan if the person or entity responsible for uploading the content failed to take it down within one week of receiving a copy of the Court’s order.
Senior Advocate N Hariharan, appearing for Kishan, submitted that obscene and pornographic material, AI-generated content and derogatory Instagram reels featuring the actor had been circulating online without his knowledge or consent. According to the plaint, the defendants were unlawfully exploiting the plaintiff’s celebrity status, public persona, goodwill, name, image and likeness to attract traffic to their respective websites and digital platforms for commercial and financial gain.
Kishan further sought removal of a radio segment titled “What is Love with Kavi Kishan” aired on Ishq 104.8 FM, alleging that the programme commercially exploited his name, image and likeness without authorisation, thereby infringing his personality rights. It further alleged that an AI-generated video featuring a mock imitation of Kishan was available on Ishq FM’s official Instagram account.
The Court indicated that it would pass a detailed interim order directing the removal of content found to be prima facie violative of Kishan’s personality rights and restraining further unauthorised exploitation of his identity. The matter has been listed for further hearing on October 15.
