Gauhati High Court adjourns PIL on declaring eco-sensitive zone around Kaziranga

The Gauhati High Court recently adjourned a Public Interest Litigation (PIL) filed by Rajeev Bhattacharyya, concerning the declaration of an Eco-Sensitive Zone (ESZ) around Kaziranga National Park. 

The petitioner argued that despite clear orders from the Supreme Court, the State Government had failed to declare the ESZ.

The PIL relied on various orders passed by the Supreme Court in WP(C) No.202/1995 (In Re: T.N. Godavarman Thirumulpad -Vs- Union of India & Ors.). 

However, the State’s counsel raised a preliminary objection, pointing out that the matter was already pending before the Supreme Court. 

The petitioner’s counsel conceded this point.

Considering the submissions, the bench of Chief Justice Vijay Bishnoi and Justice Suman Shyam adjourned the PIL sine die, awaiting the Supreme Court’s final decision on the ESZ declaration. 

The parties are free to move for listing the PIL petition after the Supreme Court’s decision.
