Gujarat High Court directs Ahmedabad Municipal Corporation to rehabilitate slum-dwellers

In a significant verdict, the Gujarat High Court has directed the Ahmedabad Municipal Corporation to ensure the rehabilitation of slum-dwellers in Piranana Chhapra, Behrampura, in accordance with the 2010 Regulations for Rehabilitation and Redevelopment of Slums. 

The Bench of Justice Sunita Agarwal and Justice Pranav Trivedi’s order came in response to a public interest litigation (PIL) filed by Shaikh Noorjahan Bano.

The litigation sought to protect the rights of 57 slum dwellers who received eviction notices in October 2023. 

The court observed that nine dwellers could not be traced, while the remaining were entitled to benefits under the 2010 regulations.

The court instructed the dwellers to file individual applications within two weeks, which will be examined by the municipal corporation. The corporation will pass separate orders after providing personal hearings within six weeks. 

Additionally, the court stayed the eviction of the dwellers until the competent authority makes a decision.
