Punjab and Haryana High Court disposes of PIL seeking development plan for Charkhi Dadri

The Punjab and Haryana High Court has disposed of a petition filed by one Anand Kumar and others seeking a direction to the State of Haryana to consider and decide on the Draft Development Plan 2041 for Charkhi Dadri within three months.

The petition, filed under public interest, sought directions for publishing the Draft Development Plan 2041 for Charkhi Dadri District, Haryana, as per Section 5 of the Punjab Scheduled Roads and Controlled Area Restriction of Unregulated Development Act, 1963. 

The State Counsel argued that the plan was approved “in principle” on July 28, 2023, but not notified.

Chief Justice Sheel Nagu and Justice Anil Kshetarpal heard the petition. 

The court relied on constitutional provisions under Article 243ZD. 

Considering the matter pending with the State of Haryana, the court directed the state to take up the matter expeditiously.

The court ordered the State of Haryana to:

-Consider and decide on the Draft Development Plan 2041 for Charkhi Dadri within three months.

-Take necessary actions to publish the plan as per Section 5 of the Punjab Scheduled Roads and Controlled Area Restriction of Unregulated Development Act, 1963.
