The Supreme Court of India has allowed recently qualified Advocates-on-Record (AORs) to take part as voters in the upcoming elections of the Supreme Court Advocates-on-Record Association, offering interim relief in a dispute over their exclusion.
The direction came during the hearing of a petition challenging the preparation of the electoral roll, which had left out several newly registered AORs. The Court ruled that those who had completed their registration formalities by mid-April would be permitted to cast their votes, though they would not be eligible to contest in the present election cycle.
The issue stemmed from administrative delays that prevented timely inclusion of these members despite their successful qualification. Petitioners argued that denying them voting rights created an unfair distinction between similarly placed professionals who had already met all substantive criteria.
Recognising the concern, the Court observed that procedural delays should not deprive eligible members of their right to participate in the functioning of their professional body. It underscored the need for fairness and inclusivity in the electoral process.
The order is expected to enable a significant number of newly inducted AORs to vote, while also prompting a review of election timelines and procedures to ensure broader representation within the association.
