The Supreme Court on Monday issued notice on the fresh bail plea of AAP MLA Naresh Balyan in a case registered against him under the Maharashtra Control of Organised Crime Act, 1999 (MCOCA).
Additional Solicitor General accepted notice on behalf of the respondent, and the Bench granted four weeks’ time to file a counter-affidavit.
During the hearing, the Bench remarked that the matter would likely be dismissed on the next date. Senior Advocate Abhishek Manu Singhvi, however, pointed out that a similar Special Leave Petition (SLP) had already been dismissed on October 9 and said he was hopeful of relief. Counsel also submitted that 17 FIRs had been referred to in the matter, without naming them.
The Bench expressed surprise at the practice peculiar to the Supreme Court, remarking that High Courts typically refrain from entertaining a second application without a significant change in circumstances.
Singhvi clarified that the present request was for an early hearing and did not amount to seeking reconsideration of the earlier dismissal.
The case arises from an FIR registered by the Delhi Police Crime Branch under Sections 3 and 4 of the MCOCA concerning an alleged organised crime syndicate headed by Kapil Sangwan alias Nandu.
Balyan, who was arrested on December 4, 2024, is alleged to have been associated with and facilitated the activities of the syndicate. The Delhi High Court, on August 3, 2026, rejected his bail plea, holding that there was prima facie material to sustain the invocation of MCOCA.
