The Supreme Court has sought the Union Government’s response to a batch of petitions raising questions over the suspension and blocking of social media accounts, agreeing to examine the legal issues surrounding the exercise of powers under the Information Technology Act, 2000, and the safeguards available to affected users.
A Bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi issued notice to the Centre while hearing a group of petitions filed by journalists, digital content creators and other social media users challenging the suspension of their online accounts by intermediary platforms pursuant to governmental directions. The Court granted the Union time to place its stand on record before proceeding further with the matter.
The petitions contend that the suspension of social media accounts has significant implications for the constitutional guarantee of free speech and expression under Article 19(1)(a), particularly where users are allegedly denied adequate notice, reasons for the action or an effective opportunity to contest the restrictions. The petitioners have also questioned the transparency of the procedure adopted for issuing takedown and blocking directions.
During the hearing, the Bench indicated that the issues raised extend beyond individual grievances and involve broader questions concerning the statutory framework governing online intermediaries, procedural fairness and judicial review of executive action affecting digital speech. It, therefore, considered it appropriate to obtain the Union Government’s response before examining the challenges on merits.
The Centre is expected to clarify the legal basis on which directions for suspension or blocking of social media accounts are issued, the procedural safeguards available to users and the obligations cast upon intermediary platforms while implementing such directions. The Court is also likely to consider whether the existing framework under the Information Technology Act and the relevant Rules adequately balances freedom of expression with concerns relating to public order, national security and unlawful online content.
The proceedings assume significance against the backdrop of increasing litigation concerning government-directed content moderation and account restrictions on digital platforms. Several petitions pending before constitutional courts have raised concerns regarding transparency, proportionality and compliance with the principles laid down by the Supreme Court in matters involving restrictions on online speech.
The Supreme Court has listed the batch of matters for further hearing after the Union Government files its response. The outcome of the proceedings is expected to have an important bearing on the legal standards governing suspension of social media accounts and the extent of procedural safeguards available to users whose digital presence is restricted pursuant to governmental action.
