The Allahabad High Court has directed the authorities to proceed with the removal of all remaining illegal encroachments in the vicinity of the Lucknow District and Sessions Court, noting that 57 additional unauthorised structures have already been cleared pursuant to its earlier directions.
A Division Bench comprising Justice Rajesh Singh Chauhan and Justice Rajeev Bharti passed the directions while dealing with two connected writ petitions concerning alleged encroachments on public land and public pathways surrounding the District and Sessions Court complex and other adjoining government establishments in Lucknow.
The Court was apprised that 14 illegal constructions had initially been removed in compliance with its earlier orders and that a further 57 encroachments had subsequently been cleared. The Zonal Officer, Zone-1 of the Lucknow Municipal Corporation, placed before the Court instructions dated September 8, 2026, along with photographs documenting the structures that had been removed.
The Bench, however, made it clear that the demolition and removal exercise could not be treated as concluded merely because substantial progress had been made.
The Court directed the competent authorities to ensure that the entire spectrum of illegal encroachments identified in terms of its earlier order dated April 7, 2026, is removed in accordance with law.
The direction follows the High Court’s earlier order under which 72 alleged encroachers, predominantly advocates, were given a further opportunity to either vacate chambers and shops allegedly occupying public pathways or public utility land, or demonstrate before the competent authority a lawful and bona fide entitlement to retain the structures.
The Court had directed the Lucknow Municipal Corporation to issue fresh notices to the identified occupants. In cases where notices were not accepted, the authorities were permitted to affix them at the concerned premises and publish them in one H
