A Delhi court on Thursday cancelled the non-bailable warrant (NBW) issued against Students’ Federation of India (SFI) leader Aishe Ghosh in connection with a 2021 case arising out of a protest outside Bangla Bhavan in the national capital.
Judicial Magistrate First Class Vijayshree Rathore of the Patiala House Courts recalled the warrant after Ghosh appeared before the court in person in compliance with its earlier direction. While cancelling the NBW, the court imposed a cost of Rs 1,000 on her.
The development comes a day after the court stayed the execution of the non-bailable warrant and directed Ghosh to remain personally present at the next hearing. Following her appearance on Thursday, the court accepted her request and recalled the warrant.
The case stems from a demonstration organised by the SFI outside Bangla Bhavan in 2021. An FIR was registered against Ghosh alleging that she and others violated prohibitory orders and unlawfully entered the premises during the protest. She has been booked under Section 188 of the Indian Penal Code (IPC) for disobedience of an order duly promulgated by a public servant and Section 447 IPC for criminal trespass.
The Delhi Police has already completed its investigation and filed a chargesheet in the matter. The criminal proceedings against Ghosh will now continue before the trial court in accordance with law.
The court proceedings assume significance in light of recent political developments involving the SFI leader. Earlier this week, the Communist Party of India (Marxist) [CPI(M)] alleged that Delhi Police attempted to arrest Ghosh from the party’s national headquarters in New Delhi. The allegation sparked a political controversy after videos circulated on social media purportedly showed CPI(M) Rajya Sabha MP John Brittas confronting a woman police official who was allegedly not in uniform during the incident.
Ghosh has recently been at the forefront of the SFI-led student protests at Jantar Mantar over alleged irregularities in public examinations. The demonstrations attracted nationwide attention and culminated in the resignation of Union Education Minister Dharmendra Pradhan on July 25.
With the cancellation of the non-bailable warrant, Ghosh is no longer required to face coercive process in the 2021 Bangla Bhavan protest case, though the criminal trial will proceed on the basis of the chargesheet already filed by the prosecution.
