Delhi court convicts Congress leader Alka Lamba for assaulting policeman during women reservation protest

A Delhi court on Monday convicted Congress leader Alka Lamba for assaulting a police officer during a protest at Jantar Mantar seeking implementation of women’s reservation in Parliament ahead of the 2024 Lok Sabha elections.

Additional Chief Judicial Magistrate (ACJM) Ashwani Panwar of the Rouse Avenue Court held Lamba guilty under Sections 132 (assault or use of criminal force to deter a public servant from discharging duty), 221 (intentional obstruction of a public servant), 223(a) (disobedience of lawful orders issued by a public servant) and 285 (causing danger, obstruction or injury in a public way) of the Bharatiya Nyay Sanhita (BNS).

The court observed that both the actus reus (the forbidden act or omission). and mens rea (criminal intent) required to establish the four offences had been proved beyond a reasonable doubt.

The ACJM further pointed out that the prosecution successfully proved its case through witness depositions and documentary evidence, leaving no doubt that the accused was liable for conviction under BNS Sections 132, 221, 223(a), and 285. The arguments on sentencing would be heard on June 5, he added.

Lamba had been formally charged in the case on December 19, 2025, after the court rejected her plea seeking discharge.

The case stems from a protest held on July 29, 2024, in support of women’s reservation in Parliament, where Lamba was allegedly the main speaker. According to the prosecution, prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) were in force around Jantar Mantar Road, and permission to march towards Parliament had been denied.

Police alleged that despite repeated warnings, Lamba and other protesters tried to breach barricades, raised slogans calling for a gherao of Parliament, pushed police personnel and blocked a public road by staging a sit-in. An FIR was subsequently registered at Parliament Street police station.

Lamba’s counsel contended that the protest was peaceful and held within a designated protest zone. It was further argued that there were no independent witnesses or medical reports showing injuries and that the video footage did not depict Lamba assaulting any police officer.
