Delhi High Court fines centre ₹20,000 for hiding facts in Sameer Wankhede promotion case

The Delhi High Court has imposed a penalty of ₹20,000 on the Central Government for concealing crucial facts in its review petition challenging the promotion of former NCB officer Sameer Wankhede. A bench of Justice Navin Chawla and Justice Madhu Jain dismissed the Centre’s plea, criticizing it for withholding information about the status of departmental proceedings against Wankhede.

The court noted that the government failed to disclose that the Central Administrative Tribunal (CAT) had already stayed disciplinary action against Wankhede before the review petition was filed. The judges observed that such non-disclosure amounted to an attempt to mislead the court.

In August, the CAT had directed that the sealed cover containing Wankhede’s promotion file be opened and that he be promoted to the post of Additional Commissioner effective from January 1, 2021, if recommended by the Union Public Service Commission (UPSC). Upholding that order, the Delhi High Court directed the Centre to comply with it within four weeks and pay the imposed costs.
